Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Patchy (“Service”), operated by Patchy (“we”, “us”). By using the Service you agree to be bound by these Terms.

1. The Service

Patchy is a developer tool that allows you to instruct a Telegram bot to make code changes to your GitHub repositories, deploy live preview environments via Vercel, and submit pull requests on your behalf. The Service requires you to connect your GitHub account, a Vercel account, and supply your own Anthropic API key.

2. Eligibility

You must be at least 16 years old to use the Service. By using Patchy, you represent that you have the authority to accept these Terms on behalf of yourself or the organization you represent.

3. Your accounts and credentials

You are responsible for maintaining the security of your Telegram account and any connected OAuth tokens. Patchy acts on your behalf using the permissions you grant — you are solely responsible for any code changes, pull requests, or deployments created through the Service.

You must provide your own valid Anthropic API key. You are responsible for all API usage charges incurred through your key. We use your key only to fulfill your code-change requests; we do not use it for any other purpose.

4. Acceptable use

You agree not to use the Service to:

  • Make changes to repositories you do not own or do not have permission to modify.
  • Generate, store, or distribute malware, exploits, or malicious code.
  • Circumvent rate limits or access controls through automated means beyond normal use of the bot.
  • Violate any applicable law or third-party rights.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Plans and billing

Patchy offers multiple subscription plans billed monthly. A “run” is one session from your first message to /approve or /discard. Unused runs do not carry over to the next billing period. Overage runs are billed at $0.75 per run.

Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our discretion for unused portions of a billing period in cases of technical failure attributable to Patchy.

6. Your code and data

You retain all ownership of your code. We do not claim any intellectual property rights over the repositories you connect or the pull requests Patchy submits. Patchy accesses your code only to fulfill your instructions during an active run.

7. Third-party services

The Service integrates with GitHub, Vercel, Anthropic, and Telegram. Your use of those services is governed by their respective terms. We are not responsible for outages, changes, or decisions made by these third parties that affect the Service.

8. Warranty disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CODE CHANGES PRODUCED BY THE SERVICE WILL BE CORRECT OR SUITABLE FOR YOUR PURPOSES.

You are responsible for reviewing all pull requests before merging. Patchy is a tool to assist development — not a replacement for code review.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PATCHY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Patchy and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any code changes made through your account.

11. Termination

Either party may terminate at any time. You may cancel your subscription at any time from your account dashboard; cancellation takes effect at the end of the current billing period. We may terminate or suspend your access immediately for violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or via the Patchy bot at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
